This is a summary of TIER II filing requirements. The filing for 2004 is due March 1, 2005. 1. The Commonwealth of Massachusetts requires any business which meets certain thresholds requirements to file a Toxic Use Report (TUR) with the Department of Environmental Protection (DEP), which includes "Form R"s for each toxic substance. A facility which meets all three of the following threshold requirements is required to file a Toxics Use Report annually: - Employed the equivalent of at least 10 full-time employees (or the equivalent of 20,000 hours worked per year); AND - Falls within at least one of the following Standard Industrial Classification (SIC) Codes: - 10 through 14 - Mining - 20 through 39 - Manufacturing - 40, 44 through 49 - Transportation - 50 and 51 - Wholesale - 72, 73, 75 and 76- Certain Services; AND - Manufactured, processed or otherwise used a TURA listed chemical at or above any one of the following specific reporting thresholds: - 25,000 pounds for a chemical that was manufactured or processed; - 10,000 pounds for a chemical that was otherwise used; - For designated Persistent Bioaccumulative Toxics (PBTs), 100 pounds, 10 pounds or 0.1 gram, depending on the chemical 2. The federal SARA 313 Form R reporting requirements are not as strict as the state's TUR program, and the Form R filed with the state is more than enough information to satisfy the federal, but the appropriate forms must still be filed separately with both the U.S. Environmental Protection Agency and the state DEP. 3. Finally, in addition, the Massachusetts Emergency Management Agency (MEMA) administers EPA's SARA 312 Tier II requirements. There is no substantive difference between state and federal requirements for this filing, but the information must be prepared using the U.S. EPA's software. The information should then be provided on diskette to the State Emergency Response Commission (SERC), Local Emergency.
