REMINDER!  2005 TIER TWO REPORTS DUE MARCH 1ST

GOT DREDGING ISSUES?
From the Desk Of….Jamy Buchanan Madeja, Esq.

What marina doesn't?

Now is our first chance in 30 years to improve the approvals process for dredging in Massachusetts. The Massachusetts Department of Environmental Protection has put out for comment changes to the dredging regulations. We need your input: please consider speaking up.

MMTA delivered verbal and written comments at the Boston public hearing on January 18th. We urge you to speak up and submit written comments before the end of the comment period January 30th.

During MMTA's testimony the following key points were emphasized:
  1. Dredging is essential to the health of the recreational marine industry;

  2. The new regulations nicely combine the dredging and hazardous waste management regulations, BUT:

  3. The changes newly require an alternatives analysis (alternative locations or doing no dredging at all), which makes no sense for maintenance dredging yet maintenance dredging is not exempted from this new requirement; and

  4. The changes as drafted are an opportunity missed to streamline the waterways permitting process to file one application to initiate all approvals (Chapter 91 licensing, Army Corps, Water Quality Certification and Wetlands Protection Act). MMTA want to take this regulations change as an opportunity to streamline the permitting process and offers the assistance of MMTA's Government relations and legal counsel.
The proposed revisions are available on the Department's website: http://www.mass.gov/dep/public/publiche.htm. Questions for DEP go to Yvonne Unger (617) 292-5893; The hearings are as follows:

The Department will accept written comments until 5.00 PM on January 30, 2006. Written comments should be submitted to the Massachusetts Department of Environmental Protection, One Winter Street, Boston, MA 02108. Please feel free to copy MMTA on any correspondence and welcomes your input. Please call Jamy Buchanan Madeja, Esq., MMTA's Legal and Government Relations Counsel at 617-227-8410, ext. 234 or jmadeja@buchananassociates.com.

Let's us make the most of this rare revisiting of dredging regulations to have a positive impact for our industry. Thank you in advance for your participation and support.

NAUTICAL TERMS OF THE MONTH FROM USCG WAYPOINTS NEWSLETTER

Did you know wishing you "Greasy Luck" was the old-timers equivalent for bon voyage and good fortune. For the whalers back in the day, it had reference for the number of barrels of whale oil that they hoped to harvest during a trip.

Did you know that "Get Out Your Web Feet" comes from an old navy slang passed down from Able-Bodied Seamen to the young Seamen to warn that they should break out their oilskins as heavy rain or snow is approaching! What are Oilskins? They are raingear or foul weather slickers.

MMTA MEMBER BOATWISE'S USCG APPROVED MASTER'S COURSE NOW EARNS COLLEGE CREDIT
