EPA PROPOSAL EASES OIL SPILL REQUIREMENTS ON SMALL FACILITIES
CHANGES TO SPCC PROGRAM

On December 12, 2006, the U.S. Environmental Protection Agency (EPA) promulgated changes to its Spill Prevention, Control and Countermeasure (SPCC) program. The SPCC program is designed to prevent spills of oil into waterways and to contain spills after they occur. Facilities subject to the program must develop spill prevention plans designed to prevent and minimize such discharges. In July 2002, EPA amended the SPCC program requirements for hundreds of thousands of small businesses, farms, manufacturers, and electrical facilities. EPA subsequently agreed to postpone the effective date of the amended rule while the agency studied several suggested burden reduction approaches for small facilities and other SPCC facilities.
EPA will now allow facilities that handle up to 10,000 gallons of oil, and that have had no "reportable discharge" of oil in the past three years, to certify their own spill prevention plans. The rule otherwise requires a professional engineer to certify SPCC plans.
EPA will allow facilities with oil-filled equipment to "implement an inspection and monitoring program, develop an oil spill contingency plan, and provide a written commitment of resources to control and remove oil discharged, for qualified equipment in lieu of secondary containment for the oil-filled operational equipment." Under the new rule, mobile re-fuelers such as airport refueling trucks are exempt from secondary containment requirements.
EPA is providing an extension of time for farms to comply with the SPCC rule "until the Agency promulgates a rule specifically addressing how farms should be regulated under the SPCC rule."
In a separate rulemaking, EPA has proposed to extend the date for owners and operators of non-farm facilities to comply with the SPCC rule to July 1, 2009.
EPA estimates that these changes, which follow many of Advocacy's recommendations on behalf of small businesses, will reduce the regulatory and paperwork burden on small facilities by $125 million, while increasing overall compliance with the SPCC program and focusing facilities on measures that will prevent oil spills from reaching waterways.

BOATERS MUST NOT OPERATE 121.5/243 MHZ EPIRBs
AFTER 31 DECEMBER 2006
The Coast Guard reminds all boaters that beginning January 1, 2007, both 121.5 and 243 MHz Emergency Position Indicating Radio Beacons (EPIRBs) are prohibited from use in both commercial and recreational watercraft. Boaters wishing to have an emergency rescue beacon aboard their vessel must have a digital 406 MHz model.
The January 1, 2007, date to stop using 121.5 MHz EPIRBs is in preparation for February 1, 2009, when satellite processing of distress signals from all 121.5/243 MHz beacons will terminate. Following this termination date, only the 406 MHz beacons will be detected by the International Cospas-Sarsat Satellite System which provides distress alert and location data for search and rescue operations around the world.
The regulation applies to all Class A, B, and S 121.5/243 MHz EPIRBs. It does not affect 121.5/243 MHz man overboard devices which are designed to work directly with a base alerting unit only and not with the satellite system.
This change, in large part, was brought about by the unreliability of the 121.5/243 MHz beacons in an emergency situation. Data reveals that with a 121.5 MHz beacon, only one alert out of every 50 is a genuine distress situation. This has a significant effect on expending the limited resources of search and rescue personnel and platforms. With 406 MHz beacons, false alerts have been reduced significantly, and, when properly registered, can usually be resolved with a telephone call to the beacon owner. Consequently, real alerts can receive the attention they deserve.
When a 406 MHz beacon signal is received, search and rescue personnel can retrieve information from a registration database. This includes the beacon owner's contact information, emergency contact information, and vessel/aircraft identifying characteristics. Having this information allows the Coast Guard, or other rescue personnel, to respond appropriately.
In the U.S., users are required by law to directly register their beacon in the U.S. 406 MHz Beacon Registration Database at: http://www.beaconregistration.noaa.gov/ or by calling 1-888-212-SAVE. Other users can register their beacon in their country's national beacon registration database or, if no national database is available, in the International Beacon Registration Database at https://www.406registration.com/.
The United States Coast Guard is the lead agency for coordinating national maritime search and rescue policy and is responsible for providing search and rescue services on, under and over assigned international waters and waters subject to United States jurisdiction.

FIRST OF ITS KIND CAPE COD BOAT BUILDERS' SHOW
TO SHOWCASE "MADE IN MASSACHUSETTS" BOATS -- JANUARY 19 - 21, 2007
For the first time in Massachusetts, boaters looking for something other than off-the-rack, production boats will find a large variety of custom-built sail and powerboats on display in one show, a showcase of exclusively "Made in Massachusetts" boat builders. The Cape Cod Marine Trades Association will present the "Boatbuilders' Show on Cape Cod" January 19-21 at the Four Points Sheraton in Hyannis.
"Smaller builders of custom boats are often lost in the maze of mainstream boat shows," says Scott Dayton of Hyannis Marina, a key organizer of the Boatbuilders' Show. "So buyers looking for the kind of craftsmanship and unique designs usually found only in limited-production boats have few opportunities to go on board and compare workmanship and features. Very much like the Maine Boatbuilders' Show when it started years ago, this is an opportunity for smaller builders to show off their craft in a larger venue, some for the first time outside of their own showrooms."
The Boatbuilders' Show on Cape Cod promises entertainment for the whole family, with boatbuilding demonstrations, unique boating accessories on display, plenty of food and snacks, and beautifully crafted pleasure boats to whet your appetite for the summer ahead. Admission is $5. Children under 12 are free, and there is plenty of free parking.

8TH ANNUAL JOB FAIR AT THE LANDING SCHOOL ON APRIL 6TH
On April 6t, 2007 The Landing School will host its 8th Annual Job Fair at its facility in Arundel, Maine. The event continues to be the largest marine trade's recruitment forum on the East Coast.
Last year the event attracted over 50 companies from across the U.S. from as far away as Washington, Canada, and Florida. Collectively, over one hundred employment positions were represented in marine systems, design and boatbuilding disciplines.
This June twenty-four boat builders, twenty-one marine systems technicians, and sixteen yacht designers will graduate from the Landing School after 10-months of intensive education. Most will find jobs in the marine trades, bringing the number of Landing School graduates actively working in their chosen field to over 1200.

CHESAPEAKE SODA CLEAN EXPANSION RESPONDS TO DEMAND
Effective Dec. 1, Chesapeake Soda Clean is opening a dedicated warehouse and customer service center in Annapolis, Md., to better serve its clients. In response to the cleaner nature of soda blasting and its positive environmental applications, the soda blast industry is in a rapid growth period, Stacey Stone, the company's owner and general contractor, said in a statement.

ULTRA LOW SULFUR DIESEL IS HERE - SOME THINGS YOU MUST KNOW

The transition from Low Sulfur Diesel with 500 parts per million sulfur content (LSD 500 ppm) to Ultra Low Sulfur Diesel fuel with a sulfur limit of 15 parts per million (ULSD 15 ppm) is underway. Federal regulations required the Environmental Protection Agency (EPA) to enforce strict guidelines to each level of the fuel distribution channel. The following are important dates to keep in mind:
On Road Clear Diesel:
Although ULSD 15 ppm will be the dominant highway diesel fuel produced, EPA does not force it as the only option available for service stations or commercial end users. However, beginning October 15, 2006 each party must make a firm choice on the diesel fuel type they plan to sell, and properly label their dispensers with the correct sulfur content (i.e. LSD 500 ppm or ULSD 15 ppm). Failure to exclusively sell one diesel fuel grade at each dispenser may result in a penalty for non-compliance with the 20% anti-downgrade provision (see details below).
Off Road Red Diesel:
EPA fuel standards for locomotive, marine and non-road diesel fuel engines and equipment, such as farm or construction equipment, will become effective at dates later than those for highway vehicles: Diesel fuel intended for locomotive, marine and non-road engines and equipment must meet the Low Sulfur Diesel fuel maximum specification of 500 ppm sulfur in 2007 (No High Sulfur allowed). Beginning in 2012, locomotive and marine diesel fuel must meet the ULSD fuel standard of 15 ppm sulfur. By June 2010, the ULSD fuel standard of 15 ppm sulfur will apply to non-road diesel fuel production.
Tank Conversion:
The receipt of ULSD 15 ppm begins the process of converting your tank or tanks to this new product. The sulfur level of the product in your tank will blend down with each delivery. There is usually no need to clean the tank or remove older product in order to transition to the new ULSD 15ppm standard. It is anticipated that tanks will be successfully converted if at least four deliveries of 80% new ULSD 15 ppm (on top of 20% old), are made to the tank.
It is important to read and follow the ULSD 15 ppm recommendations and information below for your facility to avoid generating significant problems and added expense.
ULSD, Ultra Low Sulfur Diesel will contain 15 ppm, (parts per million) of sulfur as opposed to 500 ppm in Low Sulfur Diesel (LSD).
Why ULSD?
The EPA is requiring 2007 trucks to drop their nitrogen oxide emissions by 50% and to reduce particulate matter, (soot), by 90%.
How Come?
The US Fleet of Diesel vehicles have continued to strongly grow since 2005, up by 5.7 % last
year and 2006 February sales were up over 18%. Pollution will continue to get worse if these new regulations are not implemented.
Terminals supplying Volta have been modified to isolate and segregate ULSD 15ppm to maintain the product quality to the same level that the product was delivered into its facilities. Our suppliers have also developed a quality assurance program to assist in verifying delivery of on-specification ULSD 15 ppm to us at the truck rack. The program will include routine sampling and sulfur testing at various points throughout the terminal, along with a sample retention plan to support defense efforts, in the event an EPA test at the retail level indicates fuel sourced from one of our suppliers is out of compliance. Furthermore, our suppliers will be prepared to provide documentation to defend that the product delivered through the terminal load arm was on specification.
Downgrade Provision
The downgrading provision was put in place to prevent the intentional commingling of ULSD 15 ppm highway diesel fuel and LSD 500 ppm highway diesel fuel. Downgrade refers to re-designating 15ppm motor vehicle diesel fuel to 500 ppm motor vehicle diesel fuel. The provision allows each party in the distribution system to downgrade a maximum of 20% of the highway diesel fuel bought on an annual basis. The 20% limit is there to allow for unintentional mixing/normal contamination during the compliance period, and used to protect the availability of ULSD 15 ppm highway diesel fuel.
Penalties
Potential penalty of $32,500 per violation, per day, plus economic benefit or savings for selling/fueling contaminated product, incorrectly labeling dispensers, or non compliance with the downgrade provision.
If settled informally and you are cooperative, most penalties will typically be much less.
General Defenses to Presumptive Liability:
Prove causation.
5 years of Product transfer documents are in order, (Bills of Ladings').
Show documented training program for your employees and contractors (carriers).
Show your quality assurance program.
Show amended contract language with your common carrier addressing ULSD procedures.
Show sample testing history - your own or from your suppliers quality assurance program.
Show written documentation of remedies of past contamination events that were brought forward as a result of your supplier's quality assurance program.
Impact of ULSD 15 ppm vs. LSD 500 ppm to your fleets and customers:
Concerns of lower lubricity and other chemical changes can be avoided by adding ValvTect Diesel Additive (contains VT 101 Lubricity Improver) which is available from Volta.
Supply of LSD 500 ppm may become limited and cost possibly will surpass ULSD 15 ppm.
Where We Are Today:
Over 90% of Northeast Terminals have turned their inventory effective September 1, 2006.
October 15, 2006 is the start of the 20% anti-downgrade provision for first compliance period (October 15, 2006 to May 31, 2007).
January 1, 2010 - All on-road diesel is 15 ppm.
January 1, 2012 - All off-road diesel is 15 ppm.
